What say you?

A stumbler leaves that was here for some time, in stumblers time here, they used pictures of themselves as avatars and people saved them.

Stumbler is gone, but has noticed another using their picture for an avatar and has taken steps to ask it be removed.

Stumbler using anothers picture for an avatar, refuses to remove it when asked nicely, and basically thinks it's ok to do this.

Obviously there are no rules on this, but is there a "good manners" way to deal with this?

i see what where you're going, but any stumbler that submits photos into the public on the web, should be aware that it can be used and abused.

think about what you make available to everyone , there's no need turning the SU into a "soup nazi" system because of it.

I also sympathise, but suspect there is not much you can do, unless it was a copyrighted image?

I concur with ETH, there's little anyone can actually do if the perpetrator won't collaborate. Why, oh, why would anyone want to use someone else's photo though? There are so many images out there that can be used. Sheesh!

If someone used a pic of you I would imagine if you wrote them they would remove it, if the person was nice and respectful, however this is the internet and not everyone is like that. I doubt there is anything you can do if they wont remove it.

#3: If it was 'your' image to begin with this would be the case - although i'd say it was bad form to use another persons avatar anyway - but sometimes the second user might be genuinely unaware that an avatar was 'already taken' - thare are a lot of people on here after all - hopefully that sort of situation could be sorted out in a friendly manner.

If they took the picture or created the image, then it is copyrighted. However, I take the opinion if it's on the web people will most likely use it (I do), but if the owner of that image asks for it to be removed then it should. As long as the person in question can prove that he is the owner then he can sue the abuser. Although it is probably easier to ask the devs to step in.

of course, we've always wondered what would happen if the devs received an actual cease and desist request for a copyrighted image ... was it an image you took or made?, then it is copyrighted automatically ... you need not have registered it ... so it is "pursuable" if you want to ...

if its an image you borrowed and made yours "in your heart" so to speak ... then the folks saying theres nothing you can do are right ... in fact, you borrowed the image - so you ought to be looking at that ... if youve used any other copyrighted image as your avatar, ever, you may want to be looking at that too ...

Yeah. I stopped using my previous avatar which was a cartoon because I didn't draw it, and didn't want to be breaking copyright law. I will stick to using my own lovely face from now on and hopefully nobody will try to steal it. (Ha!) Another thing to worry about.

No this is an ex stumblers actual picture.Of said ex stumbler.

And ex stumbler is a bit creeped, as I would be, and I assume most would be, it a bit stalker-ish in a sense, being someone had to actually save it and pull it out at a later date.

No copyrights here that I know of, unless there is an offense in someone "advertising" you may be someone else.
In a sense would a picture be like assuming someone's name I wonder?

I just wanted to throw it out there, see where people fall on the issue.

And of course anything you put on the web, unless specifically protected, is open season.

More or less a discussion like when to say please and thank you...Everyone's idea of polite is different.
